Adult Use

Delaware's adult-use marijuana law permits adults aged 21 and over to possess up to one ounce of marijuana, or 750 milligrams of concentrated THC products. The state is establishing a regulated market, overseen by the Office of the Marijuana Commissioner, for cultivation, manufacturing, testing, and retail sales, with a focus on social equity in the licensing process. While public consumption and home cultivation remain prohibited, and driving under the influence is still illegal, Delaware is working towards launching legal sales, anticipated to begin in 2025. This framework establishes regulations to govern the market, protect consumers, deter underage consumption, reduce the illegal market, and promote an equitable and competitive market.
